USCIS Issues Clarification on Master's Degree Exemption

This is news for folks who currently qualify for H1-B cap exemption, with Masters degree in the USA. USCIS said that in order to qualify for an H-1B cap exemption,  the conferred degree should be from an institution that is deemed as  “United States institution of higher education” at the time the degree was earned. This provision is added by now by USCIS as per the new memorandum dated May 23. Every year in addition 65,000 H1-B general visa quota, additional 20,000 foreign students having masters or higher degree from a US university are allowed to apply for for H1-B.

US President Donald Trump recently signed an executive order for tightening the H-1B visa programme  and to stop the visa abuse by some companies. The executive order was to enforce ‘Hire American’, to protect jobs and wages of workers in the US.
